OFFICIAL CONTEST AND SWEEPSTAKES RULES

These rules apply to the "Cookout Champion" Recipe Contest and the "Cookout Champion" Voter Sweepstakes.

NO PURCHASE NECESSARY. THE LAWS OF THE STATE OF VERMONT GOVERN THIS CONTEST. VOID WHERE PROHIBITED. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

ELIGIBILITY: Open to residents of the United States and the District of Columbia only, who are 18 years of age or older as of 5/7/2009. Employees, officers or directors of Chinet and Cooking.com and/or their respective affiliates, subsidiaries, parent and related companies, agencies, and individuals living in the same household (whether or not related) or immediate families (spouses, parents, children and siblings, regardless of where they live) of such employees, officers and directors are not eligible. All taxes, if any, are the sole responsibility of the winner.

Food professionals, such as chefs, food writers or recipe developers who create recipes for pay are ineligible to win a prize.

HOW TO ENTER CONTEST: Recipes must be original and must fall into the Backyard Cookout theme. Cooking.com will disqualify any recipe that has been previously published. Submit using the online form found via http://www.cooking.com/Recipes-and-More/extras/ChinetCookoutRecipeContest.aspx. Limit one recipe entry per IP or e-mail address per day. Once your entry is received, you will be entered and eligible to win a prize. Entries will not be returned.

ENTRY DEADLINE/RECEIPT: Entries must be submitted by June 11, 2009. Only entries actually received at Cooking.com will be entered. “Received” means when Cooking.com’s servers record the entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Cooking.com of an entry for purposes of these Official Rules. In the event of a dispute about the identity of an online entrant, each online entry will be declared made by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the winning entry is an online entry, the potential winner may be required to provide proof that s/he is the authorized account holder of the email address associated with the winning entry.

PRIZES: The grand-prize winner will receive a $500 gift certificate from Cooking.com. One Reader's Choice winner will receive a $200 gift certificate from Cooking.com. (If the Reader's Choice winner is the same as the Grand Prize winner, the winner may collect both prizes). Three randomly selected “Cookout Champion” recipe voters (selected from the pool of Readers' Choice voters who entered their e-mail addresses) each will receive a $100 gift certificate from Cooking.com.

Acceptance of the prize or parts thereof constitutes permission (except where prohibited by law) to use the winner’s name, likeness, and statements for publicity purposes without additional compensation or limitation. Cooking.com is not bound to replace any lost or stolen prize items. Any expenses not specifically stated are the sole responsibility of the winner.

Gift certificates are redeemable for merchandise only at Cooking.com. Any unused balance on the gift certificates will be available for future purchases under the same gift certificate number. Gift certificates are not refundable, cannot be used to purchase other certificates and have no cash value. Gift certificates cannot be applied to previous purchases.


SELECTION: Cooking.com judges will judge original recipes on creativity, taste, and alignment with the cookout theme. Decisions of the judges are final and may not be appealed. The top 10 recipes will be selected by June 18, 2009 and notified via e-mail or telephone. The grand-prize winner, readers-choice winner, and randomly selected voters will be notified by August 10, 2009. If a winner does not respond to claim the prize within 10 days, the prize will be forfeited. Prizes will be delivered as determined by Cooking.com at its discretion. To receive a list of winners, send a self-addressed, stamped envelope to above entry address by September 1, 2009.

GENERAL: By entering this contest, all copyright rights of winning recipes belong to Cooking.com and to this contest's partner, Chinet. Entry constitutes permission to use winner’s name, recipe, recipe name and any other information provided in the entry for editorial and promotional purposes by Cooking.com and Chinet, except where prohibited by law. Information collected for this Contest is subject to Cooking.com's privacy policy and, separately, by the privacy policy of Chinet.

By entering, participants agree to release Cooking.com, Chinet and their respective agents and parent companies and each of their respective officers, directors and employees from any and all liability, loss, or damage arising out of participation in this promotion or with respect to awarding, receipt, possession, use and/or misuse of any prize.

When entering, participants may opt in to newsletters and special offers from Cooking.com and MyChinet.com. Participant names will be activated within thirty days of submission. Participants are not required to opt in and participants may opt out from Cooking.com newsletters and special offers at any time once they are activated, and from Chinet’s lists as their Privacy Policy allows.

GOVERNING LAW: All issues and questions regarding the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of California. If state or local law in your place of residence prohibits this type of contest, do not enter the Contest.
All claims or disputes relating to the Contest shall be resolved in Los Angeles, California, by mediation or in a court of competent jurisdiction.
